Squarespace website template policy

• You are required to read the website template product page carefully for the specific requirements of each template All templates require a Squarespace account and a Squarespace subscription. Certain templates require a specific Squarespace subscription tier and this will be noted on the product page should it be the case.

• The Website Template ressources can be edited in Canva. Certain ressources may require Canva PRO/Canva for work' (a paid version of Canva). There is a free trial available for 30 days if do not wish to subscribe. Joining the Canva trial is suggestion only and we not to be held liable or responsible for any costs should you forget to cancel your free subscription before the trial end date.

• You are responsible for adding your existing content, such as your logo color palette, copy and images, to your template once the design has been delivered to you.

• You will receive the template exactly as it is shown in the live demo URL on the product page and it is your responsibility to preview it before purchasing. It is also your responsibility to contact Hersted Hertz with questions if needed, before purchasing.

• We are not responsible for any changes on Squarespace’s platform and cannot control the technical changes of external websites. We are not responsible for embedded third-party applications or custom code after the design is delivered.

• We cannot guarantee that our custom code will be compatible with any other code, plugins, customisations or integrations that you have already installed on your website, any future revisions, updates or versions of Squarespace or other third-party services.

• Should updates to Squarespace or other third-party services render the website template inoperable we are under no obligation to update your template or inform you.

• We will not be held liable for refunds or damages, should our offerings be rendered inaccessible to you due to network failures, server overload, backup procedures, or other similar reasons.

• We reserve the right to discontinue the website template at any time for any reason.

• We consider the design shipped and delivered upon completion of the purchasing process and access to the product being granted to You by the email invite you to your new site through Squarespace

• Should you for any reason not have received the Email invite within 48 hours of purchase it is your responsibility to reach out to us through email and request a new email invite to be sent.

• If you have not accepted the email invite and not reached out to us requesting a new one within 30 days of purchase we consider the design delivered and you are not entitled to a new invite request or refund.

• After the design has been delivered we are no longer responsible for the design and are not required to deliver/rebuild the Design if you change or delete any part of it. This includes changes to any pages pages, content, code or style settings.

• You are responsible for preserving the design. We encourage you to create a duplicate of all PAGES once the design has been delivered and save them as a backup. You are responsible for creating this backup.

• Template designs are sold as-is. Once the design has been delivered we aren’t required to inform you or offer an upgrade to a newer version or design is released.

• You are responsible for upgrading your trial site with Squarespace within your 6-month trial period. If you let your free trial lapse, you must reactivate your site with Squarespace. We will not issue you a new website template if your trial expires.

• You may not use the website template for any illegal purpose; and your use of the website template must not violate any applicable law or regulation.

• You may not Disparage, tarnish, or otherwise harm, in our opinion, Hersted Hertz and/or the website template.

• We reserve the right to use your completed & customised template Design in promotional material, including template showcase, for demonstration and marketing purposes.

• You are not permitted to use the website template as part of any effort to compete with us.

LICENSE

One template purchase grants you one-time use, non-transferable license to use the template for one site in your own account. If you wish to use the website template or any part of it’s design for more than one site, multiple templates must be purchased.

In short, 1 website template purchase = 1 website use only.

By accessing or using our templates, you agree to abide by these terms:

• You may not share, resell, duplicate or exploit the template in whole or in part.

• The template is copyrighted to Hersted Hertz and you do not have permission to represent or claim the design or structure as created by you.

• You must not remove the footer site credit to Hersted Hertz. If you wish for it to be removed you can for a one time fee of 250USD. You may add your own name if you wish as long as the hyperlink to the Hersted Hertz website is maintained.

• You may not create any derivative work or offer competing products based on information contained in your purchase.

• You may not violate our intellectual property rights, including copyright and trademark.

• Your purchase will not qualify as transferring any ownership rights, privileges, or abilities to exercise control over the website template in a manner that exceeds the limited use you are permitted in these terms.

• You may not make any copies or duplicates of the website template or provide access to it to any third parties, any persons, or entities other than Yourself, your employees or contractors.

• You understand that if You do breach the terms of use, each violation will result in a charged fee of three thousand dollars ($3,000.00), as a fee and not a penalty, that You will be obligated to pay to Hersted Hertz as liquidated damages for each violation of our licensed property.

• You will furthermore obligated to instantly terminate your use of the website template. You will be responsible for any and all expenses incurred by Hersted Hertz in connection with the collection of this charged fee for violating Hersted Hertz’s rights.

• You are permitted to use and modify examples of copy, writing, or text within the website template. We encourage you to use the copy prompt as inspiration for you own brand message. You are responsible for making any edits and modifications to the copy and you understand that the same copy might be utilised by other customers.

FOR WEB DESIGNERS

• The license for the website template are non-transferable therefor a a website template cannot be purchased on behalf of a client.

• A client can purchase a website template under their own name for their own website and have you working on it as a contractor.

• Web designers do not have permission to claim the website template as their own design for their own business website either.

• Removing the footer design credit is prohibited unless the fee of 250USD is payed.

• You can work on a website template that has been purchased by a client but cannot claim to the design as your own.

You understand that engaging in unauthorised use of our templates is considered theft, and we reserve the right to prosecute it as a civil and/or criminal offence.

EARNING DISCLAIMER

• You understand and agree that the website templates are intended to provide information and education to assist you in attaining your goals.

• You understand and agree that your success depends entirely on your business experience, motivation, and individual capacity. There are no guarantees of any kind as to your earnings and income.

Our website may feature testimonials. They are examples from past clients & customers. While these testimonials are accurate and honest portrayals of actual clients or customers sharing their opinions about our website, products and/or services, they are not a guarantee that all clients or customers will have the same, similar, or better experience.

RETURN POLICY

Hersted Hertz offers a no-questions-asked 7 days limited money-back guarantee. This guarantee is valid for seven 7 days after purchase or until ownership is transferred, whichever occurs first. We only offer a money-back guarantee on the template purchase. The Template transfer add-on service are non-refundable.

To request a refund, please contact us at  contact@herstedhertz.com and we will process your refund promptly, no questions asked.

SUPPORT POLICY

We are happy assist with any concerns regarding the template's installation, building process, downloads, and provided files, as well as any issues that may arise from them.

However, please note that we are unable to provide assistance with general Squarespace inquiries, modifications to templates or coding, or any difficulties arising from them, as well as any software-related problems.
